1. Agreement to Terms
By purchasing and using the Living Alone device, you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you may not use the product.
These terms apply to the purchase, ownership, and use of the Living Alone presence detection device and any associated services.
2. Product Description and Limitations
2.1 Device Function
The Living Alone device is designed to detect human presence using advanced motion and activity sensors and send notifications via email, SMS, or Telegram when no activity is detected for a user-configured period (1-24 hours). Living Alone also supports a distress voice sensor that enables voice-triggered alerts using on-device detection — no audio is recorded or transmitted.
2.2 No Guaranteed Detection
The device makes reasonable efforts to detect presence, but we provide NO GUARANTEE of:
- 100% detection accuracy in all environments
- Detection in all room sizes or configurations
- Performance in environments with obstacles, mirrors, or unusual layouts
- Timely notification delivery
- Email or SMS deliverability or receipt
2.3 WiFi Dependency
The device requires continuous, stable WiFi connectivity to function. We are not responsible for:
- WiFi service interruptions
- Internet outages
- Notification delays due to network issues
- Email or SMS provider failures
2.4 Third-Party Service Limitations
Notifications are sent through third-party email, SMS, or Telegram services. We are not responsible for:
- Email or SMS spam filtering causing missed notifications
- Email, SMS, or Telegram provider downtime
- Delayed email, SMS, or Telegram delivery
- Loss of notification recipient contacts
- Changes to Telegram's platform, API, or bot policies that affect notification delivery
2.5 Distress Voice Sensor Limitations
The Living Alone distress voice sensor uses on-device machine learning to detect spoken distress phrases. You acknowledge and accept the following limitations:
- No Guaranteed Detection: Detection accuracy is affected by ambient noise levels, speaking distance, pronunciation, and environmental acoustics. We provide no guarantee that a distress phrase will be detected in all circumstances.
- False Positives and False Negatives: The sensor may trigger on sounds that resemble the target phrase, or may fail to trigger when the phrase is spoken. Neither outcome constitutes a device malfunction.
- Power and Connectivity Dependency: The distress voice sensor requires continuous power supply and a stable WiFi connection to function. Detection events cannot be transmitted during power or network outages.
- Not a Medical or Emergency Device: The distress voice sensor is not a certified medical alert device, personal emergency response system (PERS), or substitute for professional emergency monitoring. It must not be relied upon as the sole means of emergency response.
3. Limitation of Liability
3.1 No Liability For
We are not liable for any:
- Personal injury or death resulting from device failure or false negatives
- Medical emergencies not detected or reported
- Falls, accidents, or incidents occurring at home
- Delayed emergency response due to missed notifications
- Emotional distress or psychological harm
- Financial losses resulting from device malfunction
- Property damage
- Indirect, consequential, or punitive damages
3.2 Maximum Liability
Our total liability for any claims shall not exceed the purchase price of the device (cap at $99.99 USD).
4. Product Warranty
4.1 Limited Warranty
The Living Alone device comes with a 1-year limited hardware warranty from date of purchase covering manufacturing defects (not damage from misuse, accidents, or natural wear).
4.2 Warranty Exclusions
The warranty does NOT cover:
- Physical damage from drops, water, or impact
- Misuse or improper installation
- Environmental damage (extreme heat/cold, humidity)
- Modifications or unauthorized repairs
- Normal wear and tear
- Cosmetic damage
4.3 Warranty Claim Process
Contact support@theor.com with photos and proof of purchase within 30 days of device failure.
5. User Responsibilities
5.1 Installation and Maintenance
You are responsible for:
- Proper device installation according to instructions
- Maintaining WiFi connectivity
- Keeping notification recipient email addresses or phone numbers current
- Regularly testing the device and distress voice sensor to ensure proper function
- Checking spam/junk email or SMS folders for notifications
- Maintaining a valid Telegram bot and chat configuration if using Telegram as a notification channel
- Ensuring the distress voice sensor remains powered and connected at all times if relied upon
5.2 Not a Safety Substitute
You acknowledge that:
- This device does not replace professional medical monitoring or emergency alert systems
- Elderly users or those with health concerns should use proper medical alert services
- Sole reliance on this device for safety monitoring is inappropriate and at your own risk
- Professional emergency services should be contacted for actual emergencies
5.3 Regular Testing
You should test the device monthly to ensure proper function. Failure to test does not relieve you of risk.
6. Acceptable Use Policy
6.1 Prohibited Uses
You may not use Living Alone to:
- Monitor people without their consent or knowledge, including through the distress voice sensor
- Violate anyone's privacy or legal rights
- Conduct unauthorized surveillance
- Breach rental agreements or employment contracts
- Stalk, harass, or threaten anyone
- Damage or reverse engineer the device
- Use in violation of local, state, or federal laws
6.2 Privacy Monitoring Consent
If monitoring an adult who is not your dependent, you must have their informed written consent to install and use this device in their home.
7. Purchase and Refund Policy
7.1 Refund Terms
All purchases are generally final. Devices may be returned within 14 days of purchase if:
- The device is unopened and in original condition
- You have proof of purchase
- Return shipping is prepaid by you
7.2 Defective Units
If your device arrives defective, contact support@theor.com within 7 days with photos for a replacement or refund.
7.3 No Refunds For
- Devices that have been used or opened
- Performance issues due to installation or environment
- Changes of mind
- Buyer's remorse
8. Assumption of Risk
By purchasing and using Living Alone, you assume all risks associated with:
- Device malfunction or failure
- False negatives (missed detection)
- Notification delivery failure
- Inadequate response to notifications
- Relying on the device for safety purposes
This assumption of risk covers any harm, injury, death, or loss that may result.
9. Indemnification
You agree to indemnify and hold harmless Living Alone, its owners, manufacturers, suppliers, and representatives from any claims, damages, or legal action arising from:
- Your use or misuse of the device
- Violation of these terms
- Violation of local laws or regulations
- Your actions relying on device data
- Claims by third parties (including notification recipients)
10. Data and Privacy
Your use of Living Alone is subject to our Privacy Policy. The device collects minimal data (only activity/no-activity status) which is used solely for notification purposes.

11. Intellectual Property
All Living Alone software, firmware, design, and branding are the property of Living Alone. You may not:
- Reverse engineer or disassemble the device
- Copy or modify the firmware
- Sell or redistribute the software
- Use the brand or trademarks without permission
12. Device Support and Lifetime Service
12.1 Support Availability
24/7 technical support is available via email at support@theor.com with typical response within 7 days.
12.2 Support Limitations
Support does not include:
- Guaranteed resolution or problem fixing
- Replacement devices outside of warranty
- Installation in inaccessible locations
13. Modifications to Terms
We reserve the right to modify these terms at any time. Continued use of the device after changes constitutes acceptance of new terms. You are responsible for reviewing these terms periodically.
14. Governing Law
These terms are governed by applicable international and local laws. Any disputes shall be resolved through binding arbitration rather than court proceedings, except for injunctive relief.
15. Severability
If any provision of these terms is found invalid, the remaining provisions continue in full force and effect.
